Today's topic: Is Body Corporate chaos incoming to QLD property in August 2025?
Why new Seller's Disclosure forms might be delayed for body corporate sales. With Queensland's new Seller's Disclosure regime kicking off on the 1st of August 2025, we've been fielding heaps of questions from agents and sellers alike about timing and compliance.
Here are two key things you need to know for body corporate matters.
Number one - if you think the property you're selling will go under contract after the 1st of August 2025, keep in mind that the use of a Section 206 Body Corporate Disclosure Statement under the Existing Body Corporate Community Management Act (BCCMA), expires on the 31st of July 2025.
So what that means is from the 1st of August 2025 onwards, the Section 206 disclosure statement is invalid; replaced with a new Body Corporate Certificate, being a Form 33 for Community Title Schemes, a Form 34 for Two-Lot Schemes, or a Form 18 for BUGTA.
Number two -many body corporates aren't ready to issue the new body corporate certificates until after the 1st of August 2025. At this stage, most body corporate managers are still finalising their processes, and the updated Body Corporate Certificate won't be available until after the new laws officially commence.
So what does that mean for real estate agents?
Well, if your seller is waiting until August to list, no Section 206 is needed. If your seller currently has an active listing, if it goes under contract before the 1st of August 2025, and you have the Section 206, no action required - you're all good.
If you don't think the property will be sold in July 2025, be prepared for some delays getting the Body Corporate Certificate for the Seller's Disclosure statement, starting 1st of August 2025 is going to be challenging.
Agents - if you're planning to sell a body corporate property in the first week of August 2025, you should seriously consider setting expectations with your vendors that in that first week of August, it's highly unlikely you'll be able to put a property within a Community Title Scheme, Two-Lot Scheme, or BUGTA Scheme under contract, as it is extremely unlikely that the body corporate certificate will be available and back in time.
This is of course required for compliance for the new Form 2 regime. This same applies for any auctions. Scheduling an auction on Saturday the 2nd of August 2025 would be a terrible idea for a property within a Community Title Scheme, Two-Lot Scheme or BUGTA Scheme, unless you are 100% sure you can obtain the Form 2 Seller's Disclosure Statement, Body Corporate Certificate, and other prescribed documents in time.
A more practical approach would be to push the auction date back, say at least one week, ideally two, to make sure the required disclosures are obtained.
